The New York Court Of Appeals has recently decided that disabilities due to a preexisting condition, as outlined in New York Insurance Law Section 3234, are to be treated as an extended waiting period instead of a permanent bar from benefit payments. As a result of this decision, New York Life Insurance Company will automatically be undertaking a re-examination of claims denied based upon preexisting conditions during the period June 27, 2004 - June 26, 2007, under the above group and franchise disability policies.
